“Renessans Palace” received special sign

The head department of architecture and town-planning of executive power of the city of Baku, has presented to located in the Yasamal district, on Zakhid Khalilov Street, the 576th quarter the housing estate “Renessans Palace”, a special sign No. 97 which is a basis for starting the construction works. We will note that in view of numerous and difficult requirements which are put before the customer and the construction project by the Code of Town Planning and Construction, the special sign which is a basis to start construction works, could receive only small number of housing estates.

In the document is reflected the purpose of object, approval in Head department of architecture and town-planning at executive power of the city of Baku of department of architecture planning of construction project, the positive conclusion of the State Agency on Control of Safety in construction at the Ministry of Emergency Situations.

Rapid development of construction sector in Azerbaijan created a basis for improvement of the Legislation in this sphere. The law at number 392-IVQ of June 29th, 2012 confirmed the Code of Town planning and Construction of the Azerbaijan Republic. According to this document except for houses with height no more than 12 meters and no more than three floors, construction of all houses demand permission. According to procedure, for the purpose of obtaining permission the customer has to file a petition in appropriate authority of executive power. It is necessary to add the copy of the document on the property right to the land plot to the statement or the document about the right of rent or use of the land plot. The appropriate authority of executive power checks the submitted documents and presents them for examination to the government institutions.

After ensuring fullness of documents, the appropriate authority of executive power for the purpose of obtaining the conclusion sends inquiry to the construction authorities defined according to appointment. The conclusion on inquiry has to be expressed within 1 month. In same time, appropriate authority of executive power, taking into account the arrived conclusions within three months considers the application and makes the decision to refuse or give the construction license. In case of the construction license, the copy of the decision, and also a special sign which is a basis to start construction works, is submitted to the applicant.

Actually, implementation of construction works on the basis of requirements of the Legislation was a complex problem until recently. According to independent researches, at the moment only 30% of new buildings are accepted on operation.

Acceptance of a new building on operation covers the receiving a special sign, and also implementing of construction works on the basis of requirements of the Code of Town planning and Construction. According to the Code, building of object, in particular a house is allowed only when the land plot has an exit to the highway. Except object, has to be noninflammable, serve formation of the healthy and safe inhabited environment, shouldn’t create the soil for accidents and undesirable risks (falling, a landslide, the fire, current blows, etc.), and also influence of noise and vibration shouldn’t pass a limit which can be hazardous to health of the person. Besides, in a house there have to be heat supply, artificial and natural lighting, acoustics (sound insulation and acoustics of rooms) has to be according to requirements, energy efficiency and economy of energy resources have to be according to requirements, the construction object has to possess the corresponding infrastructure for disabled people and other persons, with limited traficabilities.
